PirozziLex is pleased to announce the publication of an article by Melissa Mauro, Trainee Lawyer at the Firm, on the blog of the Houston Place of Arbitration (HPA), an independent non-profit organization dedicated to promoting Houston as a seat of international arbitration and fostering dialogue within the global arbitration community.
Entitled “Assistance or Delegation? The Québec Decision on AI and the Setting Aside of Arbitral Awards”, the article examines a recent decision of the Québec Superior Court concerning the setting aside of an arbitral award following the discovery of fabricated legal authorities in the arbitrator’s reasoning.
Drawing also on LaPaglia v. Valve Corporation, Melissa explores the boundaries between legitimate AI assistance and the delegation of adjudicative responsibility, addressing the implications for party autonomy, procedural integrity and the finality of arbitral awards.
The contribution forms part of the broader debate on the responsible use of artificial intelligence in international arbitration, highlighting the importance of independent judgment, verification and appropriate safeguards in preserving the integrity of arbitral proceedings.
